Ratification of the UPC Agreement
UK ratification of the UPC Agreement moved another step closer yesterday when the House of Commons’ Sixth Delegated Legislation Committee (DLC) considered and approved the Unified Patent Court (Immunities and Privileges) Order 2017. The legislation now moves to the final stage in the House of Commons which is for a motion to approve the Order to be put before the House, although a date has not yet been set for this to take place.
The House of Lords must similarly approve the Order by a Grand Committee debate (scheduled for December 6th), followed by approval by the House.
Once the Privy Council has given final approval to the legislation (including the Scottish equivalent), potentially within the next few weeks, the UK would be able to ratify the UPC Agreement.
