Restructuring of Class 42


With effect from 1st January 2002, the Nice Agreement Classification system will be restructured so that class 42 services will now fall into 4 classes.

Formerly, services which did not fall into classes 35-41 were put into class 42, which included services relating to the provision of food and drink; temporary accommodation; medical, hygenic and beauty care; veterinary and agricultural services; legal services; scientific and industrial research and computer programming. As a result, class 42 became over-crowded making cross-searching of Trade Mark Registers more difficult. The solution was to introduce more classes.

The Class 42 services are now classified as follows:

Class 42:
scientific/technological and industrial services; services relating to the design and development of computer hardware and software; legal services

Class 43:
food & drink and temporary accommodation services

Class 44:
medical/veterinary services and beauty care; agriculture, horticulture and forestry services

Class 45:
personal and social services; security services

Although re-classification of old registrations and current applications is not mandatory, it is encouraged by the UK Trade Marks Registry.
