Fee Changes at the European Patent Office

As of 1 April 2008 there will be a number of changes, not only to the amounts of the fees payable to the European Patent Office (EPO), but also in relation to the fee structure for the payment of claims fees.

Whilst there will be small increases in the amounts of most fees (mainly of the order of 5 to 100 EURO), changes of particular note are:

  • the amounts of renewal fees payable in respect of the 4th and subsequent years will increase by at least 17%; and
  • the surcharge for late payment of renewal fees will rise from 10% to 50% of the late renewal fee.

Also, the structure and amounts of the claims fees will change.

Currently, claims fees of 45 EURO are payable for each claim in excess of ten claims. However, after 1 April 2008, claims fees will only be payable for each claim in excess of fifteen claims. In addition to this change to the fee structure, the claims fee itself will increase from 45 EURO to 200 EURO per claim.
