Community Trade Mark Application Process: changes to the availability of national search reports
The Office for Harmonization in the Internal Market ("OHIM") has confirmed that national search reports will no longer automatically be provided for Community trade mark applications filed from 10th March 2008.
From this date new applications may include a request that national search reports are supplied, but a fee of EUR 192 (for search reports from all 16 participating territories) is to be levied for this service. It will not be possible to request searches only from specific territories. The period for producing searches given to the national offices taking part in the system will also be reduced from three to two months.
National search reports will continue to be automatically provided, free of charge, in connection with applications filed prior to 10th March 2008. Searches of the Community trade mark register will continue to be automatically undertaken and the results provided to applicants free of charge, regardless of the filing date of the application.
