Accelerated prosecution at UKIPO for "Green Applications"
The UKIPO have announced a scheme to allow applicants for patent applications related to green or environmentally friendly technology to request accelerated processing of their patent applications. The new scheme, known as the "Green Channel" came into force on 12 May 2009.
The new scheme differs from current accelerated processing procedure in that no reasons, e.g. being aware of a potential infringer, are required.
To enter the scheme the applicant must make a request in writing indicating that their application relates to a green or environmentally friendly technology. An indication must also be given of which action (Search, Combined Search and Examination, Publication, and/or Examination) they wish to accelerate. The new scheme will apply to existing applications as well as those filed after 12 May.
There is no definition of what actually constitutes green technology, and so this will be open to varied interpretation.
