A patent requires a minimum amount of data or other “support” to be valid, particularly in the fields of chemistry and the life sciences, where patents have been invalidated for failure to meet this requirement. This is an important consideration not only when deciding if the time is right to file a patent application, but also during examination where additional data can sometimes play a key role. An understanding of this requirement is essential to working with inventors. The webinar involves discussion by an international panel of several aspects of this requirement from the perspectives of patenting in Europe, the United States, and Canada.
